These Terms and Conditions ("Terms") govern access to and use of the services provided by Collective Underwriters, Inc. ("we," "us," "our") related to the administration of Service Contract Reimbursement Insurance Policies, including policies underwritten by Mt. Hawley Insurance Company for bed bug remediation and related coverage.
By accessing or using our services, website, or submitting a policy or claim, you agree to comply with these Terms.
1. Eligibility
You must be at least 18 years of age and legally authorized to enter into a contract in your jurisdiction to purchase or file claims under this policy.
2. Services Provided
We provide administrative services for bed bug insurance coverage that may include:
- Reimbursement for lost rental income due to a covered bed bug infestation
- Remediation services (e.g., pest control)
- Laundry and departure maid services
- Coordination with approved exterminators
All services are subject to the terms, exclusions, and limitations outlined in the insurance policy.
3. Policy Limitations
Your benefits are limited to those explicitly defined in the issued insurance policy and the "Designated Contract." Not all losses, damages, or expenses are covered. For full coverage terms, refer to your official policy document.
4. User Responsibilities
You agree to:
- Provide accurate and complete information during enrollment and claims processes.
- Retain copies of all relevant documentation (receipts, service records, rental agreements, etc.).
- Use services in accordance with applicable laws and these Terms.
Failure to do so may result in denial of services or termination of your policy.
5. Approved Service Providers
Claims related to pest control services must be handled by exterminators approved by us in advance. If the approved vendor is unavailable, you may request pre-authorization for an alternative provider.
6. Fees and Premiums
Premiums for the policy must be paid as specified in your designated contract. You are responsible for any taxes or service charges not included in the policy.
7. Cancellation and Refunds
You may cancel your policy with written notice. Refunds of unearned premiums are subject to the terms of your insurance policy and must be approved by the insurer.
We may cancel or refuse to renew policies for reasons including but not limited to non-payment, material misrepresentation, or substantial change in risk.
8. Limitation of Liability
We are not liable for:
- Consequential, indirect, or punitive damages
- Losses caused by excluded perils (e.g., war, weather, fire)
- Services not pre-approved or documented
Our role is limited to administrative support for covered services underwritten by the insurer.
9. Dispute Resolution
These Terms are governed by the laws of the State of New York. Any disputes must be filed in the courts of New York State or federal courts located therein. You waive any objection to such jurisdiction.
10. Changes to Terms
We reserve the right to modify these Terms at any time. The latest version will be posted on our website with a new "Last Updated" date. Continued use of our services constitutes your acceptance of any updates.
11. Privacy
Your personal information will be handled in accordance with our Privacy Policy (see above for the full policy). We take reasonable measures to protect your data and do not sell your information.
